AN ORDINANCE RELEASING, EXTINGUISHING AND VACATING THE RIGHTS OF THE PUBLIC IN A PORTION OF A STREET KNOWN AS A PORTION OF OLD NEW BRUNSWICK ROAD IN THE TOWNSHIP OF FRANKLIN, COUNTY OF SOMERSET, STATE OF NEW JERSEY.
An Ordinance releasing, extinguishing and vacating a portion of a street known as Old New Brunswick Road in conjunction with a recommendation made by the Franklin Township Planning Board to allow Franklin Retail to combine both Franklin Retail projects as one. One project has received Site Plan approval for a Shop Rite currently under construction and the other is a future Site Plan application for a proposed retail center, bank and restaurant to be located at the corner or New Brunswick Road and Elizabeth Avenue.

An ordinance amending Traffic Code Section 226-10 – No Stopping or Standing Prohibited During Certain Hours on Certain Streets to include the following streets with parking restricted to one side: Carmen Street, Clifton Street; DeKalb Street; Landers Street; Rogers Avenue; Viking Avenue and Waldorf Street. The ordinance also amends Traffic Code Section 226-13 – Parking Prohibited At All Times on Certain Streets to include change of DeKalb Street to both sides.

An ordinance amending the Code, Chapter 22, Trees with the following changes: (1) Change all references of the Environmental Commission to the Shade Tree Commission; (2) the Shade Tree Commission will forward their recommendations on tree removal permits within ten (10) days of its regularly scheduled meeting; (3) increase the fees for tree removal permits when there is no building permit, subdivision or site plan approval involved from $10 tot $25 per plot on land that has been or is about to be subdivided, and on all other land from $5 to $30 per tree for individual removals and from $25 to $500 per acre for clearing land of trees.

PUBLIC NOTICE
The capital ordinance, the title of which is published herewith, has been introduced and adopted on first reading at a meeting of the Township Council of the Township of Franklin, in the County of Somerset, State of New Jersey (the “Township”) held on March 27, 2007 and will be further considered for final adoption by the Township Council after public hearing thereon, at a meeting of said Township Council to be held on April 24, 2007 at 7:00 p.m. in the Township Municipal Building, in said Township, in said County.
The purpose of this capital ordinance is to appropriate the sum of $117,000 which consists of a $117,000 contribution received by the Township from the Franklin Township Sewerage Authority (the “Authority”) and now available in the Capital Improvement Fund of the Township and to expend such moneys for the payment of the purchase price of real property located on Block 151, Lots 9-11 on the official tax map of the Township for the construction by the Authority of a sewer pump station to provide additional sewer capacity for various properties within a redevelopment area in the Township known as the Renaissance 2000 redevelopment area.
A copy of this ordinance may be obtained without cost from the Office of the Township Clerk, at the Township Municipal Building, during regular business hours.
ORDINANCE NUMBER 3690
CAPITAL ORDINANCE PROVIDING FOR THE PAYMENT OF THE PURCHASE PRICE OF REA PROPERTY, IN AND BY THE TOWNSHIP OF FRANKLIN, IN THE COUNTY OF SOMERSET, STATE OF NEW JERSEY (THE “TOWNSHIP”); APPROPRIATING $117,000 THEREFOR TO PAY THE COST THEREOF.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF FRANKLIN, IN THE COUNTY OF SOMERSET, STATE OF NEW JERSEY (a majority of the full membership thereof affirmatively concurring), AS FOLLOWS:
SECTION 1. The capital purpose described in Section 2 of this capital ordinance is hereby authorized as a general capital purpose to be undertaken by the Township of Franklin, in the County of Somerset, State of New Jersey (the “Township”). For said improvement or purpose stated in Section 2 hereof, there is hereby appropriated the sum of $117,000, said sum being inclusive of a contribution received by the Township from the Franklin Township Sewerage Authority (the “Authority”) in the amount of $117,000 (the “Contribution”) and now available in the Capital Improvement Fund of the Township.
SECTION 2. The capital purpose hereby authorized is the payment of the purchase price for the acquisition of real property located on Block 151, Lots 9-11 on the official tax map of the Township for the construction by the Authority of a sewer pump station, known as the Pine Street Pump Station Project, to provide additional sewer capacity for various properties within a redevelopment area in the Township known as the Renaissance 2000 redevelopment area, such purpose to include, but is not limited to, as applicable, appraisals, surveys, legal, engineering and all work materials, labor and appurtenances necessary therefore or incidental to the acquisition of said real property.
SECTION 3. The expenditure of the $117,000 appropriation consisting of the Contribution from the Capital Improvement Fund of the Township for the purpose set forth in Section 2 hereof is hereby authorized and approved.
SECTION 4. The capital budget of the Township is hereby amended to conform with the provisions of this capital ordinance and to the extent of any inconsistency herewith, a resolution in the form promulgated by the Local Finance Board showing full detail of the amended budget and capital programs as approved by the Director of the Division of Local Government Services, New Jersey Department of Community Affairs is on file in the office of the Clerk and is available for public inspection.
SECTION 5. This ordinance shall take effect immediately after final adoption as described in N.J.S.A. 40:49-2.

The bond ordinance, the summary terms of which are included herein, was introduced and passed upon first reading at a meeting of the governing body of the Township of Franklin, in the County of Somerset, State of New Jersey, on March 27, 2007. It will be further considered for final passage, after public hearing thereon, at a meeting of the governing body to be held at the Township Municipal Building in said County on April 24, 2007 at 7:00 p.m. During the week prior to and up to and including the date of such meeting copies of the full ordinance will be available at no cost and during regular business hours, at the Clerk’s office for the members of the general public who shall request the same.
